Terms
You can return purchased goods, the packaging of which is not damaged, within the 14-day statutory period starting from the date of receipt.
The order can be canceled:
1. From the Client
The customer has the right to return the purchased Products within 14 days from the moment of receipt. Returns are permitted if the Products are in their original, factory-labeled, and ready-to-sell condition. The right of return does not apply to Products falling under the provisions of Art. 57 of the Civil Code. In order to return the Products, the Customer must provide a copy of proof of purchase and provide information about them upon return. In case of legal exercise of this right by the Customer, the Seller expressly agrees to reimburse him the amounts according to law related to the return request.
The customer must send the following data to info@rosaleawine.com:
name and surname, order number, contact phone number, bank account, reason (*optional).
The return is made to the address: Speedy’s office, Harmanli, 13 Nikola Petkov St., and is at the expense of the sender, except in cases where no mistake was made by ROSALEA (for example: the wrong type of wine sent).
2. By the Seller
Due to various reasons that prevent him from delivering the Products in the specified quantity and conditions.
Delivery
We work with Speedy. We process and ship every order within every weekday from 09:00 to 16:00. Orders placed on weekends or holidays will be shipped on the first business day.
Price of delivery to a personal address: BGN 8.50.
Price of delivery to Speedy office: BGN 5.50.
Free delivery for orders over BGN 100 (regardless of whether the customer wants their wine delivered to an office or an address).
Confidentiality
“ROSALEA” OOD, in its capacity as an administrator and processor of personal data, collects, processes and uses personal data provided by a customer, only with his express consent or when there is a legal requirement to do so. The personal data that are collected, processed and used are in the volume necessary for the provision of services by “ROSALEA” OOD, and in connection with these purposes are submitted voluntarily by the client.
The customer has the right, at any time and on any grounds related to his particular situation, to object to the processing of personal data concerning him (including profiling).
The administrator is obliged to stop the processing of personal data, except in the presence of legal grounds for it, which take precedence over the interests, rights and freedoms of the data subject, or for the establishment, exercise or defense of legal claims.
When personal data are processed for the purposes of direct marketing, the customer has the right at any time to object to the processing of personal data concerning him for this type of marketing, which also includes profiling insofar as it is related to direct marketing.
When the customer objects to processing for direct marketing purposes, the processing of personal data for these purposes is terminated by the administrator.
The customer has the right not to be subject to a decision based solely on automated processing, including profiling, which gives rise to legal consequences for him or significantly affects him, and can request human intervention from the administrator, the right to express his point of view and challenge the decision. The same does not apply when:
a) is necessary for the conclusion or performance of a contract between the client and the administrator
b) is permitted by law
c) is based on the express consent of the customer
The administrator declares that he is familiar with the text of the General Regulation for the protection of personal data and respects the principles established therein and the rights of the subjects of personal data.
Definitions
“Administrator” of personal data is a natural or legal person, public body, agency or other structure that alone or jointly with others determines the purposes and means of processing personal data; where the purposes and means of this processing are determined by EU law or the law of a Member State, the controller or the special criteria for its determination may be established in EU law or in the law of a Member State.
“Processor of personal data” means a natural or legal person, public authority, agency or other structure that processes personal data on behalf of the controller.
“Processing of personal data” is any operation or set of operations performed on personal data or a set of personal data by automatic or other means such as collection, recording, organization, structuring, storage, adaptation or modification, retrieval, consultation, use, disclosure by transmission, distribution or other way in which data is made available, arranged or combined, restricted, deleted or destroyed.
“Consent of the data subject” means any freely expressed, specific, informed and unequivocal indication of the will of the data subject, by means of a statement or a clear affirmative action, which expresses his consent to the personal data relating to him being processed.
“Personal Data” means any information relating to an identified natural person or an identifiable natural person (“data subject”); an identifiable natural person is a person who can be identified directly or indirectly, in particular by an identifier such as a name, an identification number, location data, an online identifier or by one or more characteristics specific to the physical, physiological , the genetic, psychic, mental, economic, cultural or social identity of that natural person.
“Contractual purposes” means the purposes for the processing of personal data set out in these general terms and conditions.
With these general conditions, the personal data administrator defines the purposes and means of personal data processing as follows:
Use of personal data in connection with the use of the site and processing of orders and payments.
When the customer uses the website to collect general information, he does not need to enter any personal data. The data that is collected and used in this connection is limited to the data that the customer’s internet browser transmits automatically, such as the date and time of the web page query, browser type, browser settings and IP address. This data is collected in a way that does not allow a connection with the customer and only guarantees the possibility of accessing the web pages chosen by him. The IP address is only stored for the duration of the visit to the page. No evaluation or analysis of personal data is performed.
The following personal data are collected: names, address, e-mail address and telephone – only when this is necessary to personalize the site for the customer and to process his order and payments in connection with the offered online contract service. Data of third parties is transferred only if necessary to fulfill the obligations of “ROSALEA” OOD related to service and transportation. The data that is transferred to third parties is used only for the purposes and the performance of the tasks that they are obliged to perform under the terms of the relevant agreement. The third party is a subcontractor of “ROSALEA” OOD or a member of its group of companies and processes personal data on its behalf securely and in accordance with its instructions.
Upon registration, when the customer requests additional information or personally comes into contact with employees of “ROSALEA” OOD, the administrator and processor of personal data may save and maintain a record of the correspondence, as well as include the information it contains in its database maintained in compliance with the requirements of the General Data Protection Regulation.
Information about stored data/deletion of data
The customer can update, correct, block or request the deletion of his personal data if this does not violate a legal requirement.
The customer can request information about the volume, nature, purpose and origin of the collected personal data at any time. The requested information is provided free of charge within one month to the address indicated at the end of this chapter on the protection of personal data.
Privacy Policy for Google Analytics
Website uses Google Analytics, a web analytics service provided by Google, Inc., 1600 Amphitheater Parkway Mountain View, CA 94043, USA. Google Analytics uses “cookies”, text files that are stored on the customer’s computer and enable an analysis of how the website is used. The information about the use of this website (including the IP address) generated by the “cookie” is transferred to a Google server in the USA and stored there. Google will use this information to evaluate the use of the website, compile reports on website activity for website operators and provide other services related to network and internet usage. Google may also transfer this information to third parties, provided that this is required by law or if third parties process this data on Google’s behalf. Under no circumstances does Google associate the received IP address with other Google data. The installation of cookies can be prevented by setting the appropriate browser settings; in this case, all functions of the site may not be available in full.
By using this website, you accept the processing of your data by Google in the manner described above and for the above purpose.
Expiration date
Personal data provided to us through this website will only be stored for as long as is necessary to fulfill the purposes for which it was provided. Personal data may be stored for a longer period when there is a legal basis for this and in compliance with all legal retention periods applicable to it.
Data security
“ROSALEA” OOD implements appropriate technical and organizational measures to protect personal data against unauthorized or illegal processing and against accidental loss, destruction, damage, alteration or disclosure, as technical equipment, including portable equipment, is stored in lockable areas when it is without supervision; portable equipment containing personal data is not left unattended; the administrator’s staff members use appropriate secure passwords to access systems or databases containing personal data; access to relevant databases and systems is limited to employees and subcontractors who must have access to personal data with regular password changes and updates to prevent unauthorized access when individuals are no longer engaged by the relevant party; conducting regular risk assessment and/or penetration testing of systems; employees working with personal data are aware of their responsibilities regarding the processing of personal data.
In case of doubts about violated rights related to the administration and processing of personal data by “ROSALEA” OOD, the client has the right to refer the Commission for the Protection of Personal Data.
